Terms of Service

1. What you're buying

Triune offers three services, purchasable individually or together:

• Google Review Automation — automated review requests after a completed job, one follow-up if no review is left, detection of new reviews, and monthly reporting.
• Missed-Call Recovery — automatic text replies to callers who don't get through, lead capture, and an automatically sent booking link.
• Website — a website built for your business, delivered as described at time of purchase. Optional ongoing maintenance is available separately.

What's listed on the pricing page at your time of purchase is what you're buying — not any earlier or later version of that page.

2. This service texts your customers, not just you

Google Review Automation and Missed-Call Recovery involve Triune sending text messages, on your behalf and using your business's name, to people who called your business or had work done by your business. You are responsible for having the right to have Triune send those messages, and you represent to us that:

• You have a lawful basis (such as an existing business relationship created by the customer's own inbound call, or the customer providing their number to you directly) to send each customer the messages this service sends.
• The business information you give us for carrier registration is accurate.
• You will not direct us to send, and will not use this service to send, marketing, promotional, or unsolicited messages. This service is configured for customer-service messaging only — see Section 5.

If a claim, complaint, or regulatory action arises from messages sent on your behalf because the above wasn't true, Section 10 (Indemnification) applies.

3. Fees, billing, refunds & when your guarantee starts

• Setup fee. One-time, due at signup, covering account configuration and third-party carrier registration costs we pay on your behalf. Refundable in full until we submit your carrier registration, normally within two business days of signup. Non-refundable after that — it covers work and fees already spent.
• Monthly fee. Billed monthly in advance, starting when your service goes live. Fully refundable within 30 days of your service going live — not 30 days from signup.
• Why activation, not purchase. US business texting requires carrier registration (A2P 10DLC) before any message can be sent. Approval timing is set by mobile carriers and The Campaign Registry, not by us, and can take anywhere from a few business days to longer. Dating the guarantee from activation means you get a full 30 days of a working system, and we're not refunding for time the system wasn't live.
• If carrier registration is rejected, we resubmit at no cost when the issue is on our end. If it's rejected because business details you gave us were inaccurate, the carrier resubmission fee is passed through at cost.
• No long-term contract. Services bill month-to-month, cancel any time, no early-termination fee.
• Your monthly fee renews automatically each billing period until you cancel.

4. Bundled pricing

If you purchase more than one recurring service at signup, any advertised bundle discount applies to that combined purchase only. Adding a second service later may be offered at a different price than starting with both.

5. SMS / carrier compliance

• Messages sent through Triune are customer-service messages: replies to a missed call, booking links, service follow-up, and review requests after completed work. We do not send marketing or promotional messages through this service.
• Every message identifies your business by name. Recipients can reply STOP to opt out, or HELP for support, at any time.
• No mobile opt-in information is shared with any third party or affiliate for marketing or promotional purposes. Sharing with subcontractors who support delivery of the service itself is permitted for that purpose only.
• Carrier registration (A2P 10DLC) is required before your number can send messages to US mobile phones, and is included in your setup fee for SMS services.

6. Website service

• Scope, page count, and specific deliverables are as described and agreed at the time of purchase.
• Initial build: we'll work with you through reasonable rounds of revisions until you approve the site for delivery — no arbitrary cap on getting the first version right.
• Ongoing maintenance (optional, $49/mo) includes up to one revision per month to your live site. It's a separate service from the initial build, cancelable any time; declining or canceling it later doesn't affect your ownership of the site already delivered.
• Once paid in full, the finished website is yours.
• Domain registration is not included unless explicitly agreed and paid for separately.

7. No guarantee of results

Triune improves your systems for capturing reviews and recovering missed calls — it does not guarantee a specific number of reviews, a specific number of recovered leads, search ranking, or revenue outcomes.

8. Limitation of liability

To the maximum extent permitted by law, Triune's total liability for any claim relating to the services is limited to the amount you paid us in the 12 months before the claim arose. Triune is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, even if advised of the possibility.

9. Cancellation

Cancel any recurring service at any time by emailing revops@concentricintelligence.com — that's it, no account portal to find or log into. Cancellation takes effect at the end of your current billing period. Refunds for the current period are governed by Section 3.

10. Indemnification

You agree to indemnify and hold Triune harmless from claims, damages, and reasonable legal fees arising from: (a) your breach of the representations in Section 2; (b) inaccurate business information you provided for carrier registration; or (c) your misuse of the service outside the customer-service use case in Section 5.

11. Disclaimers

Services are provided "as is." Triune disclaims all warranties not expressly stated in these terms, to the extent permitted by law.

12. Governing law & disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes not resolved informally will be brought in the state or federal courts located in California.

13. Changes to these terms

We may update these terms as the services change. Material changes will be reflected here with an updated effective date.

14. General

If any provision of these terms is found unenforceable, the rest remains in effect. These terms are the entire agreement between you and Triune regarding the services. You may not assign your rights under these terms without our consent.
